    2nd FedEx claim

In a prior thread I posted my experience with filing a FedEx claim due to damage which was paid. I have had to submit a 2nd claim where they decided to do an "Ace Ventura" to my package (A Dell Power Vault tape backup). I submitted a claim and will update to let you know how this one goes (a lot of people don't have much luck with insurance claims). This claim is a little different. My first claim was under 100.00, this one is not. I did however, declare the value when I purchased the postage and was charged extra because of the value.

I filed the claim on Monday, March 25th and will let you guys know how I do....

I had an interesting claim with ups a few weeks ago. I shipped an apple 2e computer, monitor, and accessories which I sold as a set but shipped in two boxes. The monitor arrived exploded. I filed a claim but I wasn't sure of the monitors value alone so I sent them the link for the auction. I was refunded the entire price plus shipping, actually ended up profiting more from the ordeal. Good luck.

That was my question, having them pick the package up. I filed a claim today because a computer I shipped arrived crunched. It was a vintage apple, so it was collectable, and the buyer is furious because it's now "useless" to him. I don't know if it still works, and so I want it returned. It's probably still worth some good money in working parts... but Fedex wants to charge me to pick it up, then they said after the claim is settled, if it's settled in my favor they might refund the shipping.

That sounds to me like i could get screwed with paying for this to be shipped twice and out a full refund to my buyer! How did your return work out Mike? Did they charge you for it first and then reimburse you?

Hope this helps. You are the seller. Your customer is the buyer. The shipping company is a third party agent to the transaction. When you tender the package it becomes their property in a sense. The amount of liability is limited unless you tell them the value and in which case they can increase their fee (insurance) in order to novate the contract limit. Once they deliver the package to the consignee title has transferred. If damage is incurred the amount of the claim is limited to the greater amount of the limit or the additional limit as agreed to in a unilateral decision by 1 - you insured it for more ($100 is standard for UPS ans FEDEX ground). 2 - they charged a fee for the additional insurance (think unjust enrichment offset). At this point they do not owe you the return freight unless you are willing to negotiate a lesser amount for the portion they returned.

That is because once they pay you. They own it. The shipping company or their insurance company will either
    1 - throw it away
2- if the dollars are large enough they can resell it as salvage
You can make money 2 ways.
    1 - Do what others won't.

i double insure everything thats fragile or over $100 in value, i insure thru the carrier and thru ink frog a 3rd party insurer, any loss or damage happens and i get paid double the item value, plus i can pull a chargeback on the credit card to recover my shipping costs for paying for a service that was not provided

the 3rd party insurance i use is called ShipSaver Insurance and its provided by ink frog, they will insure usps first class which no other insurer will cover

Hard to get the buyer to do this. They just want their money back and don't care about your broken stuff...
