    Guess It's Time to get legal

    After quite a bit of thought, I have decided to go ahead and file the necessary paperwork to legitimately conduct business in the state of Oklahoma.

    Getting pretty rough out here trying to find stuff, even paying good prices. Plus many of the computer repair guys I have contacted recently wanted LinkedIn profiles, websites, license number, DEQ, etc.

    I'll have to do paperwork, and pay taxes, but I think the benefits of being a Legitimate operation will out weigh the headaches.

    Many of these guys seemed to be more than willing to "donate" all of their e-waste, but only to a business who would provide paperwork for material collected.

    Guess we'll see how it goes.

    I guess the only thing I could suggest would be to consult, yep, an attorney (attorney kinda sounds better but actually was once a sort of "go-fer" and some prefer to be called lawyers ; ) An initial consultation might cost you several hundred dollars, but if you've found the right one (reasonably priced yet knowledgeable) you should have the info for putting it all together. SBA used to be helpful, I'm not sure if it still is or not, but might be worth a "chat" to see. Good luck with it man

    I plan on registering my biz before taxes are due next year, been doing the paper work for a couple years now, the only thing I don't keep track of is my time,

    You going to start an llc as well ? I've often toyed with the idea of going full time legit before but I beleive I will start an LLC when I do.

    When all your scrap cash goes into diesel, truck parts food, tools, bills rent it only makes sense for me, every thing becomes a write of. if I have to drive 30min to take my wife to a mall to replace a broken cell phone we go where its garbage day the next day and load the truck ....claim the phone, phone bill, diesel, and the dinner, ( labour cost) its all about tax brake or just not having to pay taxes. You're whole v life becomes a biz expense

    And 1956...why would anyone stop dumpster diving just because their legit?

    Possibly in the future. All I did for now was register as sole proprietor.

    I'm glad I formed an LLC and glad that I claim all of my expenses. I was unaware of how long it took weekly to sit at the computer and enter all that stuff into quickbooks online, a PO Log and a mileage log... Longer than I thought, thats for sure! For every single thing I buy that I claim I fill out a PO form, enter it into a PO Log and a mileage log. I then staple the PO form to the receipt and file it. Sounds easy but it takes a while, receipts add up quickly. It might be overkill but not doing it properly is a sure-fire way to get audited, especially in these desperate times.

    Going pro was good for my business, good for my image, and good for me but it's a lot of work. Can't be scared to work 80 hours to keep from having to work 40.

    Difference between lawyers and attorneys is that an attorney has passed the bar. The lawyer hasn't.

    aha! Attorney vs Lawyer well, if you go back far enough and dig, you'll still find the term was once used for a lawyers gofer haha ; )

    LLC. for the protection of personal asset's. If you find yourself in trouble for some reason or another, having an LLC. may save your home or other personal assets from being taken away.

    A Sole Proprietor is easier and less expensive to form but lacks advantages of incorporation.

    As a ONE OWNER/MEMBER LLC. you will claim your taxes as if you were a sole proprietor.

    A CPA or Tax adviser might recommend that you have two different accounts, A business account and a personal account.



    Why go legal???

    Most businesses will only do business with other businesses.

    I chose Sole Proprietor over LLC purely based on initial costs. Registering this way in Oklahoma involved $0 up front. I do have to pay an annual license fee of $25 but not until the end of the year. Plus the added cost of incorporating isn't justifiable to me at this moment. If you "get in trouble" there have been many cases recently where the Prosecuting Attorney tore right through the "so-called" protection an LLC is supposed to provide. I would have to start dealing with much greater volume before I incorporate.

    This is solely a part time, money making (SOMETIMES) hobby for me at the moment. I want it to grow, and i would love if i could do this full time, so I'm just taking the first baby steps that need to be taken in order for my "side job" to become more profitable. Don't want it to get too big that i get noticed doing business without a license so it made sense to protect myself a bit and hopefully it will lead to much more business.

    This is absolutely true and folks should be aware of this when debating this. I did my incorporation through Legal Zoom and it did get me started but after a month I went to a local lawyer out of fear of this very situation and he re-wrote several aspects of my articles of incorporation. More importantly he gave me some advice about small behaviors which allow me to better protect myself and my personal assets. The biggest one for me was although I had a personal Checking and Savings account and a business Checking and Savings account I had them linked together so I could easily front my business some money from my personal savings here and there when I needed it which was a big no-no. I closed the linked accounts and opened different, unlinkable accounts. He suggested that I even bank at different banks (one bank for personal, one for business) but I really like my current bank.
