    I cant get into the story to much right now if ya know what I mean. Basically Im looking for someone who is familiar with the current laws in largo florida in regards to trespassing on a construction site on less than 1 acre and more than one acre. If I find someone who has this knowledge the rest will have to be done by phone. Thank you for responding looking forward to hearing from someone who hopefully has been in this situation in this area, anything else really wont help. I have researched the FSS 810 and although a bit confusing Im learning a lot and I know there is a lot of little things to look for I just need to know what they are. I hope you can read between the lines.

    Not to be rude, but wouldn't calling a lawyer(free Consultation) be a way of getting better advice/info then a scrapping forum?

    Good luck..an I'd be dialing a lawyer.

    That is some very helpful information and now I feel really good, I suffered two anxiety attacks over this issue and Im just mentally and physically drained.

    I have called but Im trying to do as much research as possible before I meet with him on Monday to try and resolve it as quickly as possible, the atty said he has handled plenty of these types of cases but the way I feel about is that no one knows everything and every bit of information I can obtain might not only help in the situation but could keep the costs down, which are going to be high. Thanks again this is truly a very helpful site and Im so very grateful.

    Like or despise them we need the cops, 99% of the time they are just doing there job and earn a paycheck like the rest of us. If a cop is turning the "heat up" and talking to you, it's because somebody called them or they notice something odd about you, requiring a closer look. Because he or she is wearing a badge does not make them always right, like the rest of us they make a lot of mistakes. They do have one of the toughest jobs there is to do. I guarantee you most of the time, when they are doing a good job, somebody is going to think the cop is harassing them. They are doing what they have to do, just like the rest of us. As a citizen stand your ground if you think you are doing right. Ask them questions too, challenge authority if appropriate (have your $h*t together). I ran a cop off one my properties just a couple months ago. I was checking a property and i had parked my truck in the middle of the lot. I was doing what I like to do, walk the property (see things you won't see driving the property). I was at a dumpster, with a 5 gallon bucket and my "HOOK" that I use to probe dumpsters. I had put some wire and a couple of aluminum cans in the bucket. A city cop pulled up and asked, "and what do you think your doing?". I said checking this dumpster! He told me I was breaking the law and he could cite me and ticket me. I said really and what have I done? You are in violation of at least three misdemeanors and that he was going to ask me to leave the property only once! I told him I think he's maybe on the wrong property. Perhaps I'm not the person he was looking for and if ok with him, I would like to check another dumpster. He now gets out of his car (he should have done that first) tells me to put my bucket and hook down, hands on the hood and spread your legs, adding you don't listen to well do you? I told him I listen very well and heard everything he said, infact I recorded it! If it would be ok to show him my name tag and my business card. I was wearing a wind breaker but not zipped up, my name tag on my shirt, would easily been observed had he choose observation before exercising his overbearing authority. He was not done with his mouth though, Telling me I was really stealing from the trash company, as they recycle those cans and that anything in the dumpster is now their property. I asked him if he was done with me? Yes he said! Well I have some questions for you if that would be ok, Fire away he says. How about some identification, like do you have a business card with your full name and badge number. He gives me one from his shirt pocket, I handed it back to him after taking my time examining it. If you would please, write the name of you immediate shift supervisor for tonight. Now in a very low tone tells me your free to go! Oh I know that, but would he tell me, what brings the police to my property? Is there something I can help with? Now he tell me that dispatch had a call about some teenagers on the roofs. I told him I'm convinced he's on the wrong property and he should go find out where he's supposed to be. Also not to worry about my trash companies profits, they made record profits last year. One more thing I might "STEAL" all of the tash on this property and recycle it (I'm guilty). I really hope this cop decides on a new occupation or learns he puts his pants on just like the rest of us (one foot at a time). I have no idea why he was there, we have onsite security, Almost never need police. The only real crime is, metal theft (tweakers/inside jobs. If cops are needed I'm usually the one calling them to the property. I really have fun with the code enforcement and building inspectors, (I could write a book about those encounters and profit killers). Just a note about recording conversations. I do it for my own benefit (not for any court room). As a tool and a method of reviewing how I deal with people in general. I find I make a lot of mistakes when communicating with others. When I treated someone wrong, my own words let me know I need to correct and learn from my mistakes. A pilot taught me that recording tool a long time ago. He used it to review how he communicated in the cockpit, a place you want to limit mistakes and perfect skills!

    I want to be clear. I respect the police. What I don't respect is those that abuse the badge they are entrusted with.

    They do a tough job, an rarely do they get the thanks they should. Yes we the people come down hard on them. An we should, when any public servant abuses his/her position. Whether a cop, politician, etc. Do I expect them to treat me like a king? Not at all. Do I get mad people record them? Nope, not at all.

    I'll give the same answer they will..You got something to hide? If you don't then why do you care if I record you during a traffic stop? Or on a call on my street? Long as the person recording isn't stopping the police from doing their jobs, I see no issue. They can have dash cams. They can use cameras to monitor city streets, red lights, an many other places...but it's a big deal that someone chooses to record them? Seriously? Sorry that don't fly with me.

    I got no issues with the police in general. I do have an issue with bad cops. Bad cops make the rest look bad. Just like thief scrappers make us legit ones look bad. Bad apples in every profession.

    Opinion: There are some good suggestions here and some not so good. If you a sovereign citizen of any state in the United states of America and You are complying with the laws of that state and community you have rights guaranteed by the constitution and a government restricted by the Bill of rights.

    America has become Amerika because WE including ME have walked away and allowed those rights to be Ignored for the last 40 years or so.

    For whatever it's worth there are still a few " wildlife " refuges out there. The County Sheriff's office is about 40 miles away and the nearest state policeman lives at least 25 miles away.

    We're kind of on our own here so we govern ourselves accordingly. It works better because we regulate ourselves instead of having a policeman monitor our day to day activities.

    If i saw that a cop was alone and in trouble i wouldn't give a second thought stepping in, but in the same vein i would they rather not come around unless called.

    Lol .... it just feels weird,creepy and stalkerish to have a cop on patrol in the area.

    It's like Big Brother from that book 1984.

    Just an opinion, but i think we're trending a little too far to the left toward a totalitarian police state.

    Anyway .... a beat cop isn't responsible for any of this. It's just a guy or a gal doing their job. Sometimes they get a little carried away with the whole authoritarian thing. Just treat em' with respect and they will usually treat you with respect too.

    I guess this dont really have to do with scrap, but in my town we have a carwash on a parking lot in basically a small strip of stores. I was there cleaning my truck out, (vaccuming, air freshener, power washing). When I pulled up to the vaccum after finishing the power washing, 2 cars pull next to me ( 1 on either side) , They get out and i realize its a buddy i havent talked to lately. I ask him how hes been and what not, and next thing i know a squad car pulls up. Asks for I.D and everything. I was charged with tresspassing , while at a public self service car wash at 6:00 p.m. (daylight). Mandatory court date with a min. fine of $100.00, Max. fine of $750.00 . my 3 buddys were also charged , and decided to just pay the 100 dollars. i am fighting my ticket, as i feel that my rights were violated. i would rather pay the 750.00 dollars and say that i at least tried to fight it. (another mandatory court date)

    I wanted to say this...not all of us should be included in the WE, certainly not ME. I make it a point to fight anything I am not in the wrong of doing. I also am completely honest of things I AM in the wrong of doing. That policy has gotten me warning over tickets more than half the time of course I bet that Operation Iraqi Freedom Vet sticker in the back window does too...still. As for the Amerika..yanno what I think? That's kids these days, perfectly happy giving away freedoms for getting handouts. I don't need it I don't want it...I **** sure don't accept it.

    Always remember this when dealing with ordinances from city and county level: The city cannot levy a fine for an ordinance the county already covers themselves at a higher rate than the county of residence. ((That's in all 50 states, there was a supreme court case affirming this in the 70s). 2. An ordinance can add but may not take away from any superseding law. e.g. Red trucks and cars are illegal(county) red and blue trucks but not cars are illegal (City) This was also a supreme court ruling over an ordinance that alienated a law of the same at the state level. 3. The government may not claim an item rightfully or not to be the property of anyone but the owner of the land without the burden of proof while it resides on their land. Land is described quite plainly by the city planning office, often in most cities to maximize taxation the properties are split either x feet past curb, by actual marker or "at the curb. This literally means most of the curbsiding ordinances in effect are actually theft movable property. Fighting that can make it worse, let that be known.

    I'll give you an example. My previous residence in a city with curb shopping laws...WM handled the trash for the city and there was an ordinance against trash picking. I went to court over a fine (two fines actually) making the point that the trash cans are NOT WM property the recycling bins are and I was not picking the bins. WM has to prove that they have an agreement with their customers (signed) that the trash they set out is WM property at that point, by valid contract it would be. The problem is the contract is with the city not the property owner and therefore the city cannot tell anyone who's property is who without proof of ownership. Long story sort of short here...I had to go to the property owner, get written permission for the property I took (for court purposes) and avoid a theft movable property as well as the original fine by the now invalid ordinance. (Fond Du Lac no longer has a curbsider ordinance).

    This reminds me of some of the machines that i've run across through the years.

    It was a good while back, but a part of the thirty years that i've spent in the building trades was as plumber / heating tech. One day i was sent down to an older home to modernize their plumbing. They had a fairly decent hand dug well that was fed by a boiling spring year round. On top of the well was this old hand pump and by the date on the casting it appeared as though it had been in service for over seventy years

    This was a simple machine with a single purpose. It was well built with only a few moving parts. Anyone with a little common sense could operate or repair it.

    A few years ago i was working with a very complex machine. It did all kinds of wondrously different things and had well over ten thousand moving parts. Further ... it had many different sub-systems. Each sub-system was comprised of five to fifteen sub-sub-systems each requiring a specially trained & certified technician to work on it.

    This complex machine didn't work very well. It was always breaking down. When one tiny little part broke it created a domino effect that took out seven other sub-sub-systems. When it broke down ( which was every other day ) you had to call a company that was located 1,500 miles away to come and fix it. They would fly in their team of specialists who would immediately start arguing amongst themselves as to the how and why the machine broke and how to go about fixing it.

    Now ... if i hadn't been depending on that machine to work and laying out huge $$$ for the repair it would have been hilarious to watch these guys in action. It was a complete cluster**** !

    It's like that with the machinery of government.

    We started out simple enough. Way back when, the function of government was to provide for the common defense, provide a system of courts, and develop a system of roads & bridges. The legal system was fairly straightforward.

    Look at what happened over the next two hundred years. The machinery of government grew and evolved to serve many different functions. The system of law became very complex.It also become very expensive to operate.

    Yeah ... you can spend a lot of time & energy fighting the good fight to win back our freedoms in the court system but they're small victories. They barely put a dent in the machine. All the while the guvmin't is growing bigger and bigger and bigger.

    If you ask me i think we need a fundamental change of heart as a people.

    Back when our country was founded we were a proud and independent people. We didn't like anyone telling us what to do or where to go. Well over 90% of us were self employed. We succeeded or failed based on our own merit.

    Nowadays we've become afraid and dependent on the government to provide us with so many of the things that we should be taking responsibility for ourselves.

    We're afraid so we make more laws to tell us where to go and what to do. Other times something bad happens so we make a law to prevent bad things from ever happening again.

    We're afraid so we hire more policemen to protect us from all of the bad people.

    We're afraid and we want security in our lives .....but it comes at a price !

    Benjamin Franklin said it best:

    Those who would trade a little bit of freedom for a little bit of security deserve neither and will surely lose both.

    Very true Scrappah, the fact is most people are scared of anything non-conforming. They get very bent out of shape when things don't fit into their box.

    The Police have stopped to ask what I was doing, scrapping at 2am.....several times.

    First time they called the owner of the property that has the scrap dumped on it.
    He was OK with it. Since I knew a bit, that I know who the neighbours are and know them well, they were Ok with it.

    Next time they got a photo of me scrapping a microwave on the footpath. Since that was where I found it.....
    And I gave them a lesson in how to scrap one, in fine detail. Which impressed them. They like knowledge.

    It also gives them something to write in their books too.

    Since then they just stop for a talk, maybe the odd part like a oven switch or a element (which I put aside for them to pick up later. It,d be a comprimise if I gave it directly to them. They could be seen to be at fault accepting something from the public.)
    Or direct them to where they can get a second hand part.

    Now they just drive by.

    Like you Kiwi, they don't hassle me, anymore at lest. lol.

    Most of the ones that work the night shift on my sandbar know me an what I do. Sometimes they'll drive by the house at 3 am, an see me out breaking stuff down in the carport, an hit the blue lights to say hello. Sometimes they stop an chat, an then continue on their patrol. During the winter I see them more, as they drive the streets checking to make sure houses aren't getting broken into. We have a lot of that in the winter months, to be expected when most the homes here not lived in year round.

    I treat them with respect an they do the same. Now there are a few with the County sheriff dept that I'd be glad to list new jobs for but..hey there's always someone that has to act like a ****. I know one likes to bug me now an then, I just laugh an kill him with kindness an go about my business. I know the laws, an rules, an I ain't breaking a single one. For him it's simple.."Am I being detained?" "No" "Am I under arrest?" "Uh..no." "Ok, have a nice night. Be safe out there!" /wave

    He really hates it, but hey..I don't have to talk to you.

    No issues with recording police if done right. An I always say treat them the way you want to be treated..but sometimes..a **** is going to be a **** regardless. Just like the general public.

    I think it's funny a place can give them free coffee, soda, etc But ****, if they take a oven control knob it's a bribe if from Joe Q. Public.
