I think there is a section where you can file a complaint (on Ebay) against dangerous items. Might not be a bad idea to try and get it pulled before someone does kill themselves. Being that you Brass have done this correctly, you can give Ebay an "expert opinion" on why it needs to be pulled.
I can imagine that a good lawyer could build a case against Ebay if someone died no matter how many disclaimers there are.
