Just found out today in my town now if you recycle or remove scrap metal without a license its a 125 dollar fine.The license cost 100 dollars a year.And starting in july they intend to get 3% tax on anything you sell at the scrap yard.The bill has not passed yet but appears it will. This bill is something the state is doing.We don't make much now.

that would kind of suck I guess depending really what the bill details, but as a scrapper in cold iowa winters and wishing I could move to a warm state but sad because my family is here and don't want to be far, if this is a fixed this I would not mind so much as long as yards were diligent about checking because not all florida is warm but I could scrap so much more there and so many more cities 24/7 no frostbite. plus your closer to major shipping lines so yards would only be needed for light tin and such because you could ship out to cash in on the best prices

I have tried to look it up but cannot find it They talked about that last year.But the new city ordinance will screw a lot of us.

because FS 538.28 Preempts the city and county from making Laws governing the sale of regulated metals, which is defined as anything but Steel and aluminum cans

as to a tax, well there are enough tax laws in place already, technically if you sell anything but your own personal scrap you should be paying income tax on it

the fine will keep a lot of the other scrappers away. get the license because that way there will be less competition for the scrap 100.00 may hurt but will pay out over the year

Someone on Saturday got fined for scraping.And they started to tow her truck.I saw her at the scrap yard today and she was the one that told everybody to check the city website.And I found out the license would probably be 25 to 50 dollars.

And HT1 thank you for the info.By what you are saying maybe the 3% tax won't take place.Because I hear it got bogged down.My friends daughter works in tallahase and usualy gves us info on things.

So the city wants to charge you a license fee to remove scrap metal left out for "Them" to remove, this way they make out even better! Less stuff to pick up and recycle for them and a new revenue stream as you pay the fee and pick up the stuff for them...

I have tore this up, and I cannot find the ordinance allowing them to make you pay for a permit to collect scrap, BUT your (the OP's)city ordinances are very clear you simply cannot go around picking up scrap, as soon as it is placed at the designated collection point (which is probably being interpreted as curbside) it is the property of the cities licensed collector ( Waste Pro i believe) that is probably what the woman you mentioned above was being sighted with. see quoted below

"Sec. 50-2. - Purpose and intent.
(1)
The purpose and intent of this section is to ensure that all solid waste generated and accumulated within the incorporated city limits or solid waste service area shall be collected, removed, transported and disposed of to a city-designated solid waste disposal and/or recycling area by an authorized and/or licensed solid waste collector, except as otherwise provided in this section, to eliminate illegal dumping, and to promote the general health, safety and welfare of the public.
(2)
It is the intent of the city that collection and transporting of solid waste is to be done only by those authorized by the city.
(Ord. No. 19-2008, § 2, 7-7-2008)"

Now besides what we have already said even if the city lets you get a Permit to collect scrap, at that point you have made yourself a commercial business so you need insurance, DOT numbers on your truck, you will have to get a business license. so you might as well buy a franchise with 1800 got junk or college hunks hauling junk.

Brother all I can say is that Curb co in your town is a crime and there is not a **** thing you can do about it other then hope the town becomes a trashed mess and the city changes their mind... I would recommend contacting the Florida Recyclers Association but I do not think they will be on your side as the ordinance you are up against is pretty common nationwide, just seldom enforced.

Thanks HT1.I guess that means it has been law but now they are realy starting to enforce it and crack down on people.Some people do make a mess.But waste pro lets a lot of things sit for weeks at a time.When I first started I ask a cop if it was ok and he said yes.But now I see our law enforcement is handled by the sheriffs dept and i guess they don't know the laws for every city in the county.

100.00 is nothing, we pay 2000.00 per year just to be able to recycle electronics.

Maybe I need to add to the post above, I could not find a mechanism for the city to even permit collectors, they undoubtedly chose the current collection company by competitive bid. that company won and has the exclusive right(& responsibility) to collect all recyclables. the law I quoted was from 2008 so it is not new only enforcement is new.

I will speculate just a little, perhaps your city is soon or recently going to 95 Gallon automated collection bins, to make this system work (financially) the city needs to gather as much recyclables as possible, especially the higher value scrap metal and UBC's, the designated contractor probably pointed this out at a council meeting so the Mayor made a call to the Sheriff asking him to beef up enforcement.


Now I will go on a tangentPeople MUST involve themselves in local government!!! I sit through A lot of boring council meetings, so I do not get blind sided by issues like this. at the very least you need to read the agendas of the upcoming meetings , and have to be at any meeting that goes over your area of concern, in this case "solid waste"

What can you personally do about this, change your work model, and go to businesses, and offer to haul their scrap and pallets, process the scrap, and repair the pallets for sale, I did not say collect the scrap stacked up behind businesses without permission, that is at least trespassing, and potentially a theft conviction, and with all the video cameras out there the odds of you going to the pokey is 100%
