Usualy people do not mind if they have something out on the sidewalk or curb during trash nightand you take it! However, I do ask the owner BEFORE I remove an article off their property! I will tell you this from expierence, by asking the owner if you may or may not remove something, you may be able to establish a good reputation and they may agree to hold scrap items for you! scrapnscrap.

CH- a fine for what? Usually it's the guys with the supermarket wagons that get stopped. The wagon is property of the market. Also I would think that someone walking down the street with a stereo or tv under their arm at 2 a.m. Would seem to me someone that should be asked where they came from or where they are going...jmo...
You have to remember also that theft from new construction of homes is big. Houses aren't secured properly and locals know when the copper pipes and water meters get installed. For the most part the police can tell who is scrapping and who is stealing.
The officer may have simply wanted to make eye contact with you, sort of a passive agressive way of saying, "don't make a mess or cause trouble". My neighborhood has a few officers living in it, and we have a healthy share of patrol cars on our end of town. I personally don't mind. Granted, being thigh-high in a pile of "Renters Remorse Goods" isn't necessarily a position of strength when speaking to anyone especially the cops, but like many of you have stated, sincerity and neatness go a long way.

From what I read Supreme Court rulings set the foundation of law in some cases , a town can exceed the law but can't go easer then a Supreme Court ruling .
I guess if some body found them selves in a bind and had money to burn with a lawyer, town ordnances could be challenged as i was reading the right so scavange is way older the the Supreme Court
In the UK we have the theft by finding law too. But if you find something then hand it in at the police station, if no one has claimed it after a month or two months you can collect it yourself and keep it.
If you were to turn up at the enquiries desk with armfuls of metal they wouldn't be impressed, but they would have to log it. After a while I think they would work out it was easier to just let you be.

Just a thought but do the cops need a warrant to search someones trash that has been put out for garbage pick up, if they suspect that the person is involved in something illegal?
If not then I would assume fair game.
Sorry Im just venting because I just got pulled over and he was doing that to me and Im wondering why its so bad for me to do, and not for him. i have installed flooring in sheriff dept, county jail, training centers and it seems like 95 % have attitude and I dont get it. I do not know why i would be a special project unless i was breaking the law. then he could arrest/ fine if not move along. for those of you who couldnt believe my thinking well it was him doing it to me, so is he now the jerk.
Texas law states that once its put out for trash and is labeled as trash (either having a sign saying that it is trash or trash being in a "trash bin") can be taken by anyone and used for what you want.
Now you can NOT take paper work that would have someones info (ID theft) unless you are a cop or someone else who is under law and has (better be a good reason) as to why you are getting that part of there trash.
If they have a sign saying stay out or one of those signs then you can not be around it
If the dumpster or trash can has a gate or a closing around it that you would have to open to get at...then you can not be there.
If the dumpster or can is panted purple then its counted as private and you have to stay away

I was born NY near NYC there were lots of police and people , But now i live in small town USA Skippy I dare you to try that by me as you will find your self hand cuffed so fast .See if it's in the books as a law NO WAY can you test a police officer with intimidation - by me they are like dirty Harry Make my day !!

All I can say about people like that is "karma". Thankfully I've never ran into anyone like that, alot of the ones I have met while loading up have been great, some have even helped me load.
Local cops basically know what I do, heck I'm out when they're making their morning rounds. I don't make a mess, sometimes if the wind has scattered stuff, I actually do some quick clean up.
I give alot of stuff away too, times are tough.
Another story. I retired one of my old gas grills. I took the grill part of it off and just left the legs. I then attatched nice board to the top and had an instant workbench on wheels! (yep, way before scrapping and I tossed the cast aluminum grill part away. )
My father-in-law saw that and thought it was kinda neat. He was going to work one day and saw a grill by the side of the road, in the trash pile. He went to the owner's door and asked if he could have it, explaining what he would do with it. The owner said, sure, for 5 bucks. My FIL just walked away shaking his head. He had the money, no problem, he just couldn't see paying someone for something the just threw out. He was kinda mad because he even did the right thing and asked for it. He bought a workbench new instead.
