    new jersey man claims he was arrested for taking a bike from the garbage

    sometimes real news is posted there even before its news

    law on the books cited : 260-2. Restrictions on garbage removal.
    No person, except those having lawful permission, shall remove any refuse, garbage, debris, ashes or other contents of any garbage can owned or belonging to any other person.

    whether they had good reason, or if it was an underhanded ploy, it's still their law.

    There might be a way through it by asking the garbages owner beforehand. "No person, except those having lawful permission,"

    It is true. I recall Teaneck having laws over 30 years ago about this. What I do is to politely ask the property owner if I may take what they have put out. Only a few times was I told "NO".

    as soon as its put out for pickup its no longer there property, but then again is the scrap metal in a scrap metal dumpster anyone's property till its picked up, definitely some complicated laws involved

    I believe the Supreme court struck this down no less then 3 times mainly because such laws also preclude the police from searching garbage for evidence with out a warrent. mcw from the lunitic fringe

    Wow after reading some of the comments and language I have a new appreciation for how this forum is run!! I am no prude and can swear with the best of them but could you imagine how little would be learned here if that was allowed?

    That's not neccesarily true in all areas. Where I live, only the person living on the property is allowed by law to remove any item placed at the curb for trash collection.

    Wow the comments are a bit much to say the least! on that other forum But it was mentioned in another thread about littering, if a cop saw you drop something to the ground that you had picked up it would be littering. So if a cop comes around the corner and sees you removing a bike, probably going to stop you. As stated some of these laws need to be changed...

    I believe there are several municipalities in NJ that have that law. I think the town's argument is that they rely on the revenue they recieve from the recycled metals they collect to help subsidize the town's costs. I will not comment as to whether I agree or disagree with this type of regulation. Towns have the ability to pass 'ordinances' which empowers their enforcement divisions (police, code enforcement) to enforce and uphold such violations.

    Totally agree some of these laws should be changed.
    Not to get off topic, the cop in each above situation is only getting half the story and makes the decision to stop someone based on what was observed. Now he has the right to make a stop and can articulate why the stop was made which is legal. Then it's up to the cop to use some discretion when deciding to write a ticket or not. Hopefully you don't run into an over zealous officer and hopefully the one who is stopped realizes why they were stopped and and keeps the attitude in check. Remember there are three sides to a story...the person stopped, the cop who did the stopping and somewhere in the middle is what actually happened...just my two cents

    Yep, raised on the "wrong side" but I know the value of a buck! Always amazed at what people throw away as their "junk" or "garbage", but then again that is why we are all here.

    Right, wrong,offensive, good,bad or ugly i stand behind everything i say. That forums comments 90% of them were made by anonymous users so those should be disregarded. Personally im gonna take a little time to research the info before i run my mouth in a forum.

    I agree with you 100%. It is to my understanding that cops dont need a warrant to search garbage that has been put out because it is no longer property of the owner. It is not considered an unlawful search and seizure. Therefore all garbage put out is fair game.
