Just leave them there, it's highly illegal to scrap railroad equipment without express written permission to scrap it. Believe me, I've tried. My family has some property in East Texas that has an abandoned railroad running through a good portion of the property. It's been abandoned for at least 15 years and I would love to scrap it and clear the land so it can be replanted with trees for harvest. We've tried to contact the railroad multiple times asking for permission to clear our own land, but it's still a no. Railroads are super protective of their scrap/

My yard has a sign in the payout window with pictures of RR track, plates, ect saying "you steal it, we report it, they arrest you. Railroads do not give away scrap metal"

This was a good read. But for a mere 300 pounds of rr spikes, your better off leaving them alone and find some scrap in peoples backyards that they say you can have or start shopping a curbico for your scrap. Just walk away.
now if you had a set of rails going through your 83 acre ranch that was abandon, then I might look into the courts to grant me possession of the property.
