    Guilty on all charges!!

    With the risk of being too "political" here's an update about the trial of our family friend:

    Well, we're a bit deflated this morning. Our friend was fund guilty on all 12 counts last night. But then again, what is to be expected by a jury from the state government's home county for a political show trial. It would be sort of like cheering against the home football team! Perhaps some day the Machine will be defeated!!

    Humm .... is it possible that you're too close to the situation ?

    The logic that it's all a conspiracy doesn't seem to hold. It's hard to feature her as being any kind of significant threat to the machine. Why would "they" expend the effort ? Reps generally don't attack their own kind. Blaming it on the "Good Ole Boy Network" is kinda vague isn't it ?

    It makes more sense that she broke the law. There must have been quite body of evidence if she was convicted on 12 counts.

    6 petitions x 2 counts each were the charages out of 150+ petitions (?) turned in.

    Yes, I agree, she wasn't a threat to taking the election away from the machine, although that's the rationale for keeping our election laws "sacrosanct" (supposedly this is one of the only cases of wrongful petition filing nationally that has ended up with felony charges). Her real danger to the machine was a medical "boat rocker: especially how federal funding to the state dept. of social services (e.g. foster care/medical care given to NA kids not on the reservations) was (is) being spent. Let's just say that there isn't much oversight on the fed side on how the state is spending the money. Don't need a nosy doctor upsetting the apple cart. Convict her of a felony and the state med board gets to yank her license.

    Yeah, probably too close to the situation but its slimier than you imagine from Maine.

    Now I've probably crossed the line and got "too" political...

    I hear you. Same thing only different here. We've been trending left of center for almost 40 yrs now.

    You know ... my nephew had a drug problem but he was a good guy. He was beloved in the community. Long story short: After a night of partying his girlfriend ran him over with her car in an intoxicated haze.

    Female judge .... both the prosecution and defense female as well. I think his girlfriend got off with something like three years in prison and extended parole.

    This reeks of liberal gender bias but maybe i'm too close to it ? This one's personal !

    Justice has been served so you have to leave it at that but it would be better if she never shows her face around here ever again. That one is bad seed !

    Sorry to hear about your nephew. Hopefully his ex-gf straightens her life up and can get the message of what can be learned from this terrible event out to other people with similar problems.

    Ahh ... she's just evil by nature. She was physically abusive to him all during their relationship. She was even that way to my boys when we used to babysit her at age three. Some folks are just built that way.

    I was thinking about your friend after my last post. Politics is a nasty business. She probably did step on some toes but i'm wondering if she might have been attacked by the opposing team. That would make sense because one of the most important things to them has been to expand federal government spending on healthcare. Somebody that rightfully calls that into question would be a prime target.

    I would wait & see. Now that she's been convicted it will go to sentencing. If the punishment is proportional to the crime there may be nothing to it. On the other hand .... if they go out of their way to be vindictive and "make an example of her" there might be more going on than meets the eye.

    An update to this story. Our friend received her sentencing. Our local rag which has coverage over half the state makes it looks so benign, she got probation (yeah, with a potential 24 years hanging over her head if probation fails). Parts of her probation include that her husband can no longer have firearms if they stay married, they can come into their home at anytime without a warrant, she has to provide them with her e-mail and social media passwords, she must give them 5 days notice that she is leaving the state, blah blah, blah, blah. She might end up with the last laugh however because she's out on one of the reservations right now doing her community service and the Indians like her being a doctor and don't like the state attorney general. We'll see...

    Annette Bosworth sentenced to 3 years probation

    I wrote a letter-to-the editor to our rag but they won't publish it because its too long. They limit letters to the editor are 300 words and guest columns 500-700 words. Mine is 1,100 words. I won't post it here because its probably too political (although I took it past state corruption to abuses of power at the federal level and gave some current examples of that) but I'll try the last paragraph. Pretty generic but still pointed I think:

    So, as we have recently celebrated our “Independence Day” from foreign tyranny several centuries in the past, let us keep in mind that perhaps we have allowed tyranny back in, this time not from a foreign source but from our own inability to keep our governmental leaders and their bureaucracies corralled as servants of us instead of our rulers by their ability to bring governmental power to bear against us. Something for us to think hard about instead of taking in the 4th of July as a time of pretty fireworks and family picnics. Freedom and democracy is hard work and the vast majority of us, myself included, have for far too long allowed the elites of political power and the bureaucracies they create and maintain to operate on their own with no effective supervision. If our liberty is to continue throughout the 21st century, this must change…

    I have been watching this story with great interest and appalled at the story from beginning to end. This was Dakotarogs thread, so I was carful not to derailed it. First I do not have a vested interest in this individual, she is not a close friend, and I am not active in the politics in our state. I read, try to stay informed, and vote by my values. With that said, I add this perspective based on liberal media reporting.

    We have a doctor that spent a great deal of time and money to obtain this position. She volunteers her skills to third world countries, Native American communities in our great nation, and still has a thriving private practice requiring time and effort. Every minute she volunteers her time to the needy is money out of her pocket. Yet she continues to volunteer her time and expertise.

    Feeling she could contribute more to her community, she decides to run for public office to be a servant of the community. She combines this venture with everything else she is trying to do and has to depend on others in order operate within the confines of social etiquette.

    Annette signs petitions and is charged with violation of voter laws. So we have a crime without a victim. Is this truly the definition of a felony? She is convicted of twelve felonies and faces prison time, loss of her medical license, and being black balled in our society (pun intended.)

    Sentence is probation with community service. Before the punishment is decided she was back volunteering on our reservations. Is this a criminal or a saint? I did not know about the firearms restriction until DakotaRog mentioned it. The guess is that they were concerned she might have a weapon to protect herself while traveling throughout the Buffalo Commons.

    Bottom line - I would vote for this women as president because of her desire to help others, commitment to her home, and desire to improve life for all of those around her. If this is the result of a political machine, it is time to put the machine out of it's misery. If it is the result of laws and protocol, it is time to review them. If it is the result of stupidity, we cannot fix that without electing common sense into office.

    So to Annette Bosworth, my respect and appreciation is publically communicated. If I had been on the jury, you would have been assigned the position of Surgeon General of the Great State of South Dakota as your punishment. In addition I would have required you to obtain a CCP to defend your goals. If I was vindictive you would have also been required to serve as chairman of a committee investigating political activities in the state.
    Give back more to this world than we take.

    I'm going see what my sister has to say about this case, she's somewhat connected and has worked for the last three governors in the state of SD. Her concern is educating the children, especially the ones that life never really gave them much of a start in the first place. She tries to stay politically neutral, hard to do in any state, especially when you need funding for the programs that you want funded!

    It seems just based on the very little I have started to learn, prison would not serve anybody but those that have a desire to maneuver in these very small political circles in the state of SD. Very seldom (IMO) do we get 1 + 1 = 2 "justice" in our legal system anymore!

    I would agree with this in 99% of the cases, but in this situation I think it was a naïve person trying to make a difference. She did not have the knowledge, advisors, or insight to deal with the political environment she was trying to change.

    I posted this on my FB page tonight:

    So, the SD Medical Board yanked Annette Bosworth's license this evening. Surprise, knowing how the things were already stacked by the unholy alliance of corrupt one-party 40 year rule and the medical-industrial complex even though Annette spoke eloquently how she has served the underprivileged in this state, often out of her own wallet. I know some of you don't like her because of her politics and some are sick of this story but I dare you to read this essay from U.S. News & World Report, hardly the flagship media outlet of the hard right. I like the writer's last paragraph:

    "Though we might like to think so, Bosworth's case is not exactly as isolated as it would seem. Zealous prosecutors and law enforcement officials across the country are bending if not breaking the rules outright to compile impressive conviction rates, secure headlines and satisfy personal urges. This is not justice; this is the rule of man over the rule of law, and it must not be tolerated."

    I'll add a couple of my own: selective enforcement of the law and/or selective prosecution by the state (generic,any scale) is a very, very bad thing for democracy in the long run. When a majority of people no longer believes that democracy works for them or even if a critical mass is reached, then Katie bar the door...

    South Dakota politics just got dirtier. Back story on this one was that Chad Haber embarrassed AG Marty Jackley in 2014 when he ran against him (a non-attorney) on the Libertarian ticket after the state Dems failed to field a candidate against Jackley. Haber got 18% of the vote against Jackley, the most a Libertarian candidate has ever gotten in the SD state election but most were probably frustrated traditional Democrats who wanted to vote as a protest. Good chance that POS Jackley will the next governor of SD. All hail King Marty!!
