Maybe we can start bringing in Catalytic Converters to the Mall and get cash instead.. I don't get anywhere near $300 bucks for one.
How Ironic these two topics got posted on the same day. One adds a mile of red-tape to honest folks trying to make a few bucks selling scrap metal... The other story shows how easy thieves can get their hands on something and turn it in for cash.. right at the mall!
I'm so into scrapping.. When my Steel Toe Boots Wear out, I cut the Steel out of them and recycle the Toe!

i could see suing the mall for the theft if i was a victim, the mall leased the space to the company that owns the machine
the mall gave means, motive, and opportunity to the thieves

Why would you sue the mall? The PERSON stole it from you, not the mall. That would be like me having my iPhone stolen and suing Verizon because they are the cell phone provider and they gave a motive for someone to steal it (the phone being a valuable item). It doesn't make any sense.
Ok then, someone steals your scrap and sells it to the scrapyard. Who are you going to sue, the person or the scrapyard?
Or, the theif that steals your cell phone sells it on Ebay! Who are you going to sue then?

Well, Gravitar; you're making that very common mistake of trying to use common sense & logic to figure out the legal system. The way it oughta be and the way it is are two different things. When a lawyer is looking at an incident trying to figure out who to go after, culpability takes a backseat to pocket depth. The thieves obviously already don't have a pot to piss in, and you'd never get a thin dime out of them even if you won a judgement. The mall, on the other hand, would likely cave & throw some money at you just to avoid a long drawn out court battle with high priced lawyers of their own. To be clear, I'm not saying I agree with this, or that it makes any kind of logical horse-sense... but it IS the way things are done.
